Terms of Service (United Kingdom)

Company details: CogniHex Limited is registered in England and Wales with company number 16595626. Its registered office is recorded at Companies House and can be viewed on the public register. These Terms form a binding agreement between you and CogniHex Limited for your use of ExamAlly. By creating an account, purchasing paid access, accepting these Terms, or using ExamAlly, you agree to be bound by them. These Terms incorporate the Privacy Policy, Cookie Policy, Refund and Cancellation Policy, Acceptable Use Policy, AI and Content Transparency Policy, Copyright and IP Complaints Procedure, and Academic Integrity and Educational Disclaimer. Cookie consent is handled separately where required by law.

1. The Service

ExamAlly provides independent educational practice tools, including TMUA-style practice questions, worked solutions, flashcards, analytics, performance insights, and related learning features. ExamAlly is not an official examination product.

ExamAlly is not affiliated with, endorsed by, sponsored by, or approved by TMUA, Cambridge Assessment Admissions Testing, UAT-UK, universities, or any exam organiser unless CogniHex expressly states this in writing.

ExamAlly does not publish official past papers or proprietary exam organiser content.

Users are responsible for checking official sources for exam dates, rules, format, syllabus, eligibility, and admissions requirements.

2. Eligibility and accounts

ExamAlly is intended for students aged 16 and over. CogniHex does not routinely ask users for their date of birth and does not routinely verify age.

If you are under 16, you may use ExamAlly only with approval and supervision from a parent or guardian.

If you are under 13, you must not create an account or use ExamAlly unless your parent or guardian has approved and supervised your use.

If you are under 18, you confirm that you have permission from your parent or guardian before purchasing paid access or using a payment method.

Accounts are personal, non-transferable, and may not be shared, sold, rented, assigned, or used by more than one person.

3. Payments and access

Paid access is sold as fixed-duration digital access, not an auto-renewing subscription. Premium access expires automatically at the end of the paid period shown at checkout.

Stripe processes payments. CogniHex does not store full card numbers.

Prices are shown in GBP and, where VAT applies, include VAT unless stated otherwise.

Paid access is supplied immediately after successful payment. By completing a purchase, you request immediate access to ExamAlly digital content and acknowledge that you may lose any statutory 14-day cancellation right once digital supply begins, subject to your statutory rights. See the Refund and Cancellation Policy.

4. Licence and intellectual property

Subject to these Terms and payment of applicable fees, CogniHex grants you a limited, revocable, non-exclusive, non-transferable, personal licence to access ExamAlly for your own private educational preparation. You must not copy, scrape, redistribute, or use ExamAlly content to train AI systems or build competing products. CogniHex owns the question bank, solutions, analytics, and related intellectual property.

5. Educational reliance

ExamAlly is for educational practice only. It does not guarantee any exam score, admission outcome, or improvement. Content may contain errors; use judgement and official sources.

6. AI-assisted content

CogniHex may use AI tools internally to assist with drafting and checking educational content. ExamAlly does not use third-party AI providers to provide live tutoring, marking, or personalised feedback to learners in the current consumer product, and learner personal data is not sent to third-party AI providers for those purposes. 7. Acceptable use

You must comply with the Acceptable Use Policy. CogniHex may suspend or terminate access for breach, fraud, or harmful use, subject to mandatory consumer rights.

8. Availability and third-party providers

ExamAlly is provided on an “as available” basis. CogniHex uses third-party providers such as Google Cloud Platform/Firebase, Stripe, Google Analytics (with consent), Resend, and internal content tools. Failures by those providers may affect the Service.

9. Refunds and consumer rights

The Refund and Cancellation Policy applies. Nothing in these Terms limits statutory rights under UK consumer law.

10. Privacy and cookies

Personal data is processed as described in the Privacy Policy. Cookies are described in the Cookie Policy. Non-essential analytics run only where consent has been obtained.

11. Liability

Nothing excludes liability that cannot be excluded by law. Subject to mandatory consumer rights, CogniHex’s total aggregate liability to a consumer in any 12-month period is limited to the greater of £100 and the total fees paid by that user to CogniHex for ExamAlly during that 12-month period.

12. Changes to these Terms

CogniHex may update these Terms and linked policies. Material changes will be notified by reasonable means and may require renewed acceptance before further use.

13. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, subject to mandatory consumer rights.
